Welcome to Vividha Vision! These Terms of Service (the "Terms") govern your use of our website (www.vividha-vision.com) and our services, including our career guidance services and the AstroDISC™ framework (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using our Services, you confirm that you are of legal age and have the legal capacity to enter into a binding agreement. If you are using our Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. If you do not agree to these Terms, you must not use our Services.  

2. Description of Services

Vividha Vision provides career guidance services designed to help individuals discover career paths aligned with their authentic selves. Our approach involves a unique framework called AstroDISC™, which combines DISC personality insights with Vedic astrology.

  • AstroDISC™: This framework integrates modern behavioral science (DISC) with elements of Vedic astrology to provide a holistic understanding of an individual's innate strengths, tendencies, and potential career alignment. It is important to understand that Vedic astrology is used as a tool for self-discovery and understanding inherent personality traits and is not used for prediction of future events or outcomes.

3. User Accounts

To access certain features of our Services, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account and to update your information as necessary. You must notify us immediately of any unauthorized access to your account.  

4. Payment and Fees

  • We currently offer beta services free of charge.
  • Future pricing for our services will be clearly communicated on our website.
  • You agree to pay all fees associated with your purchases, and you are responsible for any applicable taxes.
  • We use third-party payment processors. Their terms and privacy policies apply to your payment transactions.

5. User Content

  • You may provide us with information, feedback, testimonials, and other content ("User Content").
  • You retain ownership of your User Content.
  • By providing User Content, you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with our Services and our business, including for marketing and promotional purposes.  
  • You represent and warrant that you have the right to provide your User Content and that it does not violate the rights of any third party.
  • We may, but are not obligated to, monitor or remove User Content that we deem inappropriate, offensive, or in violation of these Terms.

6. Intellectual Property

  • Our Services and all content included therein, including the AstroDISC™ framework, its methodology, and related materials, are owned by Vividha Vision and are protected by copyright, trademark, and other intellectual property laws.  
  • You may not reproduce, modify, distribute, display, or create derivative works of any part of our Services without our express written consent.  
  • You may use our Services for your personal, non-commercial use only, in accordance with these Terms.
  • "AstroDISC™" is a trademark of Vividha Vision, and you may not use it without our prior written permission.

7. Disclaimer of Warranties

  • Our Services are provided on an "as is" and "as available" basis.  
  • We make no warranties, express or implied, about the suitability, reliability, availability, timeliness, accuracy, or completeness of our Services.  
  • To the fullest extent permitted by applicable law, we disclaim all warranties, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.  
  • Specifically, Vividha Vision's services are designed for self-awareness and guidance, and the user is solely responsible for decisions made as a result of the service.

8. Limitation of Liability

  • To the fullest extent permitted by applicable law, in no event shall Vividha Vision be liable for any indirect, incidental, special, consequential, or punitive damages, including, but not limited to, damages for lost profits, lost data, or business interruption, arising out of or in connection with your use of our Services.  
  • Our total liability to you for any claim arising out of or relating to these Terms or our Services shall not exceed the amount you paid (if any) for the Services in the preceding [Number] months.  
  • This limitation of liability shall apply regardless of the form of action, whether in contract, tort (including negligence), strict liability, or otherwise.  

9. Indemnification

  • You agree to indemnify and hold harmless Vividha Vision, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or in connection with your use of our Services, your User Content, or your breach of these Terms.

  • These Terms shall be governed by and construed in accordance with the laws of India.
  • Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in [Belagavi, Karnataka, India].
